Clinicians sometimes make mistakes.

When those mistakes happen, whether they are due to negligent surgery, wrong prescription of drugs or a misdiagnosis, somebody gets hurt and in the worst cases, lives are lost.

Where a mistake is made compensation can be awarded. If a life changing event has resulted from medical mistake, compensation can be substantial.

It is important to understand that not every person who has a “poor result” from clinical procedures has a claim. Clinical/Medical negligence is a very complex area, and to prove a claim expert medical evidence is needed. Compensation is awarded for the injury itself, and in addition the cost of medical or nursing care, in the most severe cases accommodation costs, and loss of earnings can be recovered. Compensation can never put right the physical effects of a medical mistake, but it can make it easier to deal with life afterwards.

The cost of making a claim can be high but there are various methods of funding available. We can advise you about the best way of funding your case.

We do not carry out legally aided work.

No win no fee

We are happy to provide our services on a “no win no fee” basis which is sometimes called a conditional fee agreement. These are quite complex agreements but basically in respect of our own costs we agree to make no charge unless the case is successful. However, there are expenses that have to be paid such as court fees and expert fees and depending on the case and the circumstances in some cases we will be willing to fund those on a client’s behalf, in other cases we will not and the client will need to pay those as they are incurred.

Private

Following the initial interview it may be that we do not consider the claim is suitable for a no win no fee arrangement, but sometimes we will recommend that investigation is worthwhile, and will be willing to undertake this on a normal private client charging basis. We will provide full details at the first interview of this.

Legal expenses insurance

Many people have insurance policies which cover legal expenses in the event that they need to obtain the services of a lawyer. It is therefore important to check all insurance policies which you have in place, including home, motor, travel and credit card insurance. We maybe able to deal with your case with the benefit of legal expenses insurance if your insurance company agree that we may so act.
